摘　　要：自《人民法院五年改革纲要》提出增强裁判说理以来,传统"人的进路"改革遇到了困境。在信息经济学视阈下,裁判说理实质上是一个不完全信息动态博弈的过程。根据不完全信息动态博弈理论的指引,裁判说理改革基本要义可归纳为:切实保障庭审参与者各方享有充分博弈的机会,通过正当程序有序展开诉讼进程,使各方诉讼策略不断呈现、接受辩论、修正策略、妥协或融合等,从而在整体上由信息不对称向信息基本对称方向发展,以期接近或者获得参与各方的最优策略组合,即诉讼中的"精炼贝叶斯纳什均衡"状态,最后通过书面裁判形式交付给受众。这种以重塑庭审为核心的裁判说理改革进路(即"制度的进路")之所以应当被提倡,是因其合乎诉讼规律和人性,其彰显了裁判博弈的真诚无碍和庭审活动的正当有序,充满了情和理的交汇、智慧的碰撞与融合、最优策略的较量与妥协。Since the "Five-Year Reform Outline of the People's Court"proposed to strengthen the referee's reasoning, the traditional "people's approach"reform has encountered difficulties.In the field of information economics,referee reasoning is essentially a process of incomplete information dynamic game.According to the guidance of dynamic game theory of incomplete information,the basic principles of the referee theory reform can be summarized as:effectively guarantee the opportunity of all parties to the trial to enjoy full game,and proceed with the litigation process through due process,so that the litigation strategies of all parties are constantly presented and accepted.Debate,revision strategy, compromise or integration,etc.,and thus develop from the information asymmetry to the basic symmetry of the information as a whole,in order to approach or obtain the optimal combination of strategies of the parties involved,that is,the "refined Bayes Nash equilibrium"in the lawsuit.The status is finally delivered to the audience in the form of a written referee.This kind of referee who re-models the trial as the core of reasoning should be promoted because it conforms to the law of lawsuit and human nature,which demonstrates the sincerity and judgment of the refereeing game.It is justified and orderly,full of the intersection of emotion and reason,the collision and integration of wisdom,and the contest and compromise of optimal strategy.
