摘 要:羁押前审讯历来都被视为产生违法审讯、乃至刑讯逼供的重要阶段。经过国家持续多年的法律治理,违法审讯的面貌已经发生改变。基于西南某市A派出所的个案研究发现,民警的日常审讯基本符合法律规定,但在刑讯逼供等极端违法审讯已逐步销声匿迹的情况下,民警的其他违法审讯,特别是审讯程序违法依然存在。国家不仅需要治理审讯方法违法,也需要正视、严加规范民警的审讯程序违法问题。通过进一步提高两种违法审讯的可识别性、可验证性及惩罚成本的同时,实现民警审讯行为的事前防控,配套改革公安机关内部的相关制度,最大程度地降低我国刑事审讯的违法性,以提升公安民警办案公信力。Pretrial interrogation has always been considered as an important cause of illegal interrogation. After being controlled and regulated for several years, illegal interrogation has already been minimized. In the case of Police Station A in a city in the southwest of China, it is found that most interrogations are legitimate, but some procedures of the interrogations still against the law, although extorting confessions have been extinct. Not only do the methods of interrogation need to be controlled, but procedures of interrogation require further regulation. Increasing the identification and punishment of two types of illegal interrogation, accompanied by reforming internal management regulations of the police, would effectively control the wrongful conducts and improve levels of public trust.
