广东社会信用环境及其优化问题——从信用卡犯罪遏制的视角

摘　　要：在经济犯罪发展为社会主流犯罪的趋势中,伴随银行卡产业高速发展,信用卡犯罪逐渐成为高发性金融犯罪,广东信用卡犯罪形势尤为严峻。现有理论研究与司法实践探索一定程度上推进了我国信用卡安全与信用卡犯罪防范机制的建立,但未能治本。治本之策在于优化社会信用环境。基于信用环境现状,广东应以信用基础立法制定为着力点,构建社会信用环境正式制度框架,并通过信用道德规范建设,重塑社会信用非正式制度环境。In the trend of economic crime developing into mainstream crime in society and along with the rapid development of bank card industry, credit card crime has gradually become a high incidence of financial crimes, especially in Guangdong province. The existing theoretical research and judicial practice exploration have promoted the establishment of credit card security and credit card crime prevention mechanism to a certain extent, but failed to deal with the root causes. The solution to this problem is to optimize the social credit environment. Based on the analysis of the present situation of credit environment, this paper holds that Guangdong should focus on the enactment of legislation on the basis of Credit, set up the formal institutional framework of social credit environment and remold the informal institutional environment of social credit through the construction of credit ethics.
