讯问录像推动“以审判为中心”改革之潜力发挥路径研究

摘　　要：以审判为中心的改革对被告人供述的传统证据规则带来巨大冲击:庭前供述笔录将受到更严格的审查与质疑,回归对自愿性的过程性而非实体性审查是其必然要求。在此背景下,有效发挥讯问录像的证明潜力对于推动"以审判为中心"的价值主要体现在:部分案件中将其作为"备用证据"佐证讯问笔录的合法性与真实性,在部分案件中部份案件中逐步取代涉嫌非法的讯问笔录而直接作为证据(电子供述)使用,此外,讯问录像还能减少翻供而推动认罪认罚,进而促进程序的简化。有效发挥讯问录像推动以审判为中心改革之潜力的程序与证据要求包括:录像之电子供述证据地位的确立;律师在场权的设置与定位;律师阅卷权的全面保障;讯问录像误导性防范机制的建立。The trial-centered reform has a huge impact on the traditional evidence rules of confession. In this reform, pre-trial confession transcripts will be subject to more rigorous review. It is thus required the factor in the voluntariness review should be the procedure of obtaining a confession, instead of the substance of a confession. In furtherance of "trial-centered" reform, interrogation videos would play a signifi cant role. In some cases, interrogation videos can be used as "auxiliary evidence" to corroborate the legality and authenticity of interrogation record. In certain cases, interrogation videos can gradually replace the interrogation record and become direct evidence(as electronic confession).in addition, interrogation videos can reduce confession withdrawal, increase guilty plea rates and help to simplify trial procedure. to fulfill the above purpose, the following issues should be resolved: recognizing interrogation videos as electronic confession evidence;furthering the right to lawyer during interrogation;promoting the comprehensive protection of the defense counsel’s right to discovery, and establishing a mechanism to prevent the production of misleading interrogation videos.
