摘 要:当前行政协议的司法审查面临步骤不清以及依据、规则不明的困境,因而要重构其思路。首先应以意思表示一致、缔约主体、约定内容判断是否成立行政协议。其次若非对人身权的处罚或强制,行政机关皆可缔约,除非法律法规规章禁止。再次,缔约行政机关未必是行政主体,但应有相应职权,并遵守程序和形式规定。复次,要分别双务协议与和解协议各自需遵守的规范,要求协议在内容上不得违反法律法规规章的规定,并审查有无民法上的效力瑕疵。最后,违法行政协议原则上无效。At present,judicial review of administrative agreement is reduced to a dilemma of implicit steps and ambiguous basis and rules,which calls for new thoughts. First of all,the establishment of administrative agreement should be determined on the basis of identical expressed intentions,contracting subjects and contents of agreement. Second,were it not for punishment or enforcement of personal right,administrative bodies can conclude an agreement unless forbidden by laws and regulations. Third,contracting administrative bodies are not necessarily administrative subjects but they shall possess corresponding authority and observe regulations on procedures and forms. Last but not least,norms which are respectively followed by bilateral agreement and reconciliation agreement should be differentiated. In terms of content,the agreement shall not violate laws,regulations and rules,and shall have no blemish in civil law validity. The consequence of administrative agreement violation is invalidation in principle.
