摘 要:受案范围的立法改革要致力于最大程度的解决行政争议,并且解决争议应以保护公民、法人和其他组织的合法权益为主要目的。但是实现这一目标有多重制约因素,既有文本内的,还有文本外的:行政争议性质认定泛政治化、特权化,司法权被过度抑制,司法最终裁决原则没有真正确立,法院的裁判能力有限等。修法时应采取开放的框架,务实的设计,对制约因素进行选择性的突破。The goal of amending the scope of accepting cases of administrative litigation should be set as 'to solve administrative disputes as many as possibly can be, and mainly to protect the lawful rights and interests of the citizen,legal person or other organizations during dispute resolution'. However, there are several factors, both within and beyond the legal text, may hinder the realization of the goal. The most important ones are: Many administrative disputes are politicized or privileged; the judicial power is over suppressed; the principle of judicial final settlement has not been established; and the ruling ability of the court is limited. Taking all these into account, first it should better set up an open framework in the amendment of the law, and then try to overcome the obstructive factors in a pragmatic way, which means 'not try to accomplish the whole task at one stroke'.
