摘　　要：应当预见规则是各国合同法在确定合同违约损失赔偿时普遍遵循的原则。在探讨违约损失赔偿范围历吏演变的基础上,应当预见规则的产生则有其历史的逻辑。应当预见规则体现了合同当事人对公平的法律价值和效率的经济理性的平衡把握,使合同制度所追求的公平与效率在这一规则中得到了完美的结合。Predict rule is a principle generally followed by contract law of all countries when compensation for loss caused by breaking a contract is to be decided. In studying the historical evolution of the range of compensation for losses caused by breaking contract, we find that the appearance of depict rules has its own historical logic. Predict rules represent the concerned parties balanced grasp of the economic rationale of the value and efficiency of the justice of law, and makes justice and effciency pursued in contract system combine perfectly in this rule.
