摘　　要：沉默权是人类反对封建专制的斗争中取得的重要成果之一 ,沉默权的确立是司法走向文明的一种标志。沉默权制度有其科学性和合理性 。Right of silence is one of the fruits got from the struggles against feudal arbitrary by human beings. Its establishment is a signal that marks the beginning of the steps from judicature to civilization. Right of silence is both scientific and rational. So it has the important and realistic significance to establish the right of silence system.
