摘 要:我国航空消费者的权利保护已成为一个突出的问题。航空承运人与消费者之间因航班延误导致的冲突日益激烈,但立法上的空白导致行政执法中无法可依,使航空消费者权利难以得到有效保护。美国航空消费者保护法规内容全面、精细,针对性强,并且征求社会公众意见是立法的法定程序,再加上美国运输部和承运人建立的良好互动关系和美国运输部强有力的行政执法行为,使航空消费者的权利得到了有效的维护。美国有关航空消费者保护的立法和执法实践,对于我国的航班延误立法、航空消费者权利保护以及航班延误的治理无疑具有重要的借鉴意义。Safeguarding the rights of aviation consumers in China remains a prominent issue. The conflicts between air carriers and consumers caused by flight delay become increasingly fierce. Due to the absence of a legal basis protecting the rights of aviation consumers became an empty phrase. The Aviation Consumer Protection in the US is comprehensive, precise, and specific. Its legislation experienced statutory procedure and solicited public opinions. Cood interaction between the Department of Transportation and the airline companies and the powerful execution of this law implemented by the Department of Transportation both effectively help maintain the effectiveness of the Aviation Consumer Protection. The legislation and execution of the Aviation Consumer Protection in the US are of great reference to China's law makers in terms of the protection of aviation consumers and the settlement of conflicts caused by the flight delay.
