摘  要:论文以惠州市最具代表性的三个小区业主委员会成立、运作及维权情况为例,认为业主自治现存困境主要是"三难":自治机构的"成立难"、"生存难"、"维权难"。导致业主自治现存困境的原因主要有:自治机构法律地位不明确、业主自治意识淡薄、缺少必要的支持与监督。完善业主自治制度对策是:完善相关法律规定、提高业主自治意识、突出职能部门角色。Taking the foundation,operation and protection of three residential owner committees in Huizhou City as an example,this paper points out three existing difficulties in owner autonomy,i.e,difficulty in setting up autonomous institutions,difficulty of surviv-al,and difficulty of right-protection. The main causes of these difficulties are:not clear legal status of autonomous institution,weak au-tonomous consciousness of the owners,and lack of necessary support and supervision. The countermeasures to perfect the owner auton-omous system are:improving the relevant laws and regulations,uprising the autonomous awareness of the owners,and highlighting the role of functional departments.
