《侵权责任法》视角下的高校体育伤害事故法律责任的认定研究

摘　　要：高校体育伤害事故屡屡发生,体育教学秩序受到了不同程度上的影响,如何正确、合理的处理高校体育伤害事故纠纷,进行合理合法的责任划分,具有重要的现实意义。《侵权责任法》的颁布,为正确划分高校体育伤害事故的责任提供了坚实的法律依据。按照《侵权责任法》的规定,高校体育伤害事故纠纷应当严格适用过错责任,在特殊的情况下可以适用无过错责任,但是不应当适用公平责任。the university sports injury accident occurs repeatedly and the management of sports teaching is affected to some extent differently. Therefore, how to correctly and reasonably treat disputes of sports injury accident in universities and to legally and properly divide responsibilities are of great practical significance. The promulgation of ＇The tort liability law＇ provides legal basis for correct division of liabilities to university sports injury accident. In accordance with ＂The tort liability law＂, university sports injury accident must stick to doctrine of liability for wrongs. Under special conditions, principles of liability without fault can be applied while it＇s not suitable for the fair responsibility principle.
