西方文学作品中宗教与法律分离现象分析

摘　　要：受"法律与文学"运动的影响,在法律与文学两个研究领域的接壤处,从文学研究者的视角出发去探索文学作品中的法律现象已成为一个新的研究热点。文章首先对西方社会中法律与宗教的发展与变迁进行了简要回顾,然后选取了三部西方脍炙人口的文学名著,并还原到其当时的法律语境中,从血亲复仇向民主法制的进化、宗教与法律的分离引发的政治统治权威建立、宗教权威的逐步消解所带来的社会与法律的秩序混乱这三个层次对西方法律演变历程中法律与宗教的分离现象进行研究,希望在文学的积极协助下,增强人们对西方社会法律在发展演变过程中与宗教的相互影响的认识,更加深刻地理解和弘扬法的价值和宗教的精神。Influenced by the academic movement known as ＂the law and literature movement＂, it has become a new hotspot to explore the legal phenomenon of literary works from the perspective of literary researchers in the area where the law studies and literature studies meet. In this paper, the writer briefly reviewed law and religion development in western society, then set the legal contexts by selecting three very extraordinary western masterpieces. From such three aspects as the evolution from blood revenge to democracy and the rule of law, the establishment of politi- cal authority due to the separation of law from religion and the chaos of society and law due to the gradual disappearance of religion authority, the writer studies the phenomenon of the separation of law from religion. With the help of literature, the writer tries to reinforce the recognition of the interaction between law and religion during the evolving process of law in western society , and to carry forward the value of law and the spirit of religion.
