摘 要:利用地方司法机关的改革试验逐步推动制度变革是中国刑事诉讼制度改革的新动向,这是一种渐进式的制度变革方式,刑事诉讼地方试验式改革是其具体展开形式。这种方式体现了上级选择性控制与地方司法机关主动选择的微妙结合,与一步到位的立法修律式改革相比有很多明显的优势,但也存在诸多内在局限。中国刑事诉讼制度改革不能过于迷恋刑事诉讼地方试验式改革,它需要鼓励与支持地方司法机关的改革试验,更需要顶层设计与顶层推进,也无法离开一步到位的立法修律式改革的支持。It has been a new trend to use local judiciary reform in pilot programs to gradually promote institutional changes in China's reform of criminal procedure system. This is a gradual way of institutional change, and the local experi- mental reform is the specific deployment of this mode. This method reflects the subtle affinity between the selective control by superior authorities and initiative selection by the local judiciary system, with many obvious advantages as compared with the once-and-for-all legal revisions. However, this method also contains a number of inherent limitations. Reform of Chi- nese criminal procedure system shall not be over-obsessed with such local experimental reforms; it needs to encourage and support local judiciary reform and experiments, but it also needs to promote top-level designing and the top-level promotion, which cannot be possible without the support for once-and-for-all legal revision.
