摘  要:一直以来,非诉行政案件执行中的"执行难"、"执行效率低下"等现象日益严重,影响了法律的权威和尊严。随着行政强制执行制度改革的深化,非诉行政案件执行模式的创新、优化,成为我们关注的焦点。从浙江法院的实践中,可以看出我国非诉行政案件执行制度的演变背景和一些现实存在的问题。"裁执分离"机制的完善需要通过突出法院的司法审查和监督指导职能,政府重新定位以提高非诉案件执行力,落实"程序合法、补偿到位"的原则三方面来实现。For a long time, the phenomenon such as ‘difficult enforcement’ and ‘inefficiency’ in non litigious administrative cases become ever more serious, affecting the authority and dignity of the law. Along with the deepening of the administrative enforcement system reform, the innovation and optimization on the implementation mode of non litigious administrative cases become the ifrst concern for people. From the court practice in Zhejiang province, its evolution background and existing problems can be explored some. So the improvement of the mechanism of ‘separation of adjudication and implementation’ needs the support from three aspects, namely, the judicial review as well as supervision and guidance function of the court should be highlighted, the role of government should be relocated to strengthen the non litigious case enforcement power, and principles of ‘procedural legitimacy and appropriate compensation’ should be implemented.
