摘　　要：犯罪人格现象是否存在,是一个在刑事法学中引起争论的问题。犯罪学上犯罪的概念应与刑法学保持一致,人格缺陷是犯罪生成原因中的一个变量因素。犯罪人格最终是作为法律观念形态存在的,表现人格缺陷程度的概念。犯罪人格这一概念应当重新定义,新概念表明:在某些情况下,严重的人格缺陷是犯罪生成的主要原因,从而为犯罪预防指明了方向。Is there an appearance of criminal personality？ This is a problem being discussed in science of penal law. The solution of problem is decided by two premises, criminal definition on criminology and criminal reasons. Criminal personality is an existence of lawful concept at last, based on theories that criminal definition on criminology should keep up with criminal law and drawback of personality is a variable factor in criminal reasons. The valuable of criminal personality on science of penal law is that the concept shows that serious drawback of personality is a capital reason in some crimes and points out the direction for criminal prevention.
