论我国结果加重犯的主观罪过判定

摘　　要：结果加重犯是由于发生了法律上规定的更为严重的结果,而使得其刑事犯罪更为严重的犯罪行为及其形态,它一般由基本犯罪与加重结果两部分构成。所以,结果加重犯主观罪过的判定可具体化为基本犯罪故意之判定和加重结果过失之判定两部分。结果加重犯之基本犯故意的判定,其关键是判定行为人对犯罪行为本身的故意性,但行为人对基本犯罪加重结果是否认识不影响结果加重犯的成立,但影响其司法量刑;加重结果过失之认定可转化为对行为人预见能力之判定,为防范司法判断的肆意性,并最大限度确保个案审判之公正,对行为人预见能力之判定,我国宜采用主观标准说。另外,基于结果加重犯的固有缺陷,该种刑罚之法律适用应该得到限制,本文提出的判定结果加重犯之主观罪过方式正合此旨。然从本质上说,肯定结果加重犯的法益价值与限制其法律适用之范围,乃注重预防之刑事政策与强调归责之责任主义间相互较量之结果。于是,在当今立法下,对结果加重犯主观罪过认定之研究将呈现更为精细与更重实证之学术倾向。The consequential aggravated offence is a more severe criminal act and type of more severe guilty in its conse- quence, usually consists of two parts of the fundamental of fence and the aggravated consequence. Therefore, the judgment of subjeetive culpability of the consequential aggravated offence can be specialized in the judgment of intention in the funda- mental offence and the judgment of negligence in the aggravated consequence. The key to judge the former is to judge whether the criminal act is done on purpose, and the understanding of the criminal for the aggravated consequence would not affect the establishment of the aggravated consequential offence, but the judicial sentence. The judgment of negligence in the aggravated consequence can be regarded as the judgment of the predictability of the actor, in which we should use the subjectivism to ensure the justice of the trial to the most degree. Moreover, owing to the inner default of the consequential aggravated offence, its legal application in practice should be limited, in which the subjectivism put forward here is to the aim. Essentially speaking, the affirmation of the legal value of the consequential aggravated offence and the limit of its legal application is a comparative result between the criminal policy laying stress on prevention and the liability laying stress on culpability. In the current legislation, the study of the judgment of the consequential aggravated offence will be more detailed and empirical in the future.
