摘 要:《环境保护法》修订案中的排污者义务和责任条款的实效受到有关条款可操作性的制约,对可操作性的分析从法律的完整性、明确性和协调性三个方面进行。排污许可管理和环境监管部门的查封扣押权的规定属于法律不完整;建设项目未评先建的法律责任、重点排污单位监测和信息公开义务、企业事业单位制定突发环境事件应急预案的义务、建设单位充分征求公众意见的义务、超标超总量的法律责任等条款属于法律不够明确,相对而言,规定行政拘留适用的条款具有较强的可操作性;有关按日计罚的规定则和其他法律不协调。因此,有必要分别不同情况对有关条款进行落实、细化和解释。The effectiveness of clauses of polluter's obligations and responsibilities in Amendment of Environmental Protection Law is constrained by operability of relative clauses. The operability research will discuss on completeness, explicitness and harmony of the law. The incompleteness of the law appears in the provisions of pollutant discharge license management and environment supervision department's power of sealing-up and distraining of property. The inexplicitness of the law occurs in the provisions which allow construction to be made before EIA, in that regulating obligations to monitor and disclose the information of key polluters, the pro- vision stipulating response to the emergent environmental incidents, in that soliciting public opinions and that of penalty for exceeding discharge standard and total amount. In contrast, the provision of administrative detention is more operable. The disharmony of law occurs in the clause of daily penalty. It is necessary to implement, concretize and interpret the relative clauses according to narticular situations.
