摘　　要：立法的不明确容易引起附带民事诉讼间接损失赔偿的争议。从法理依据、国外或地区对附带民事诉讼间接损失立法和司法实践、国家法制统一、公平正义等角度出发,我国附带民事诉讼损失赔偿应当包含间接损失,并在理论研究、立法等各个方面对附带民事诉讼间接损失赔偿制度加以完善,特别是应当确立刑事被害人补偿制度。Unclear legislation causes a controversy over indirect loss compensation incidental civil action. Based on legal principle, indirect loss legislation with incidental civil lawsuit and juridical practice abroad, national legal system unification, fairness and justice and so on, the loss compensation incidental civil lawsuit should include indirect loss in our country and we should better the system in theory research, legislation and so on. And we should establish the system of the compensation for criminal victims.
