试论依法加强网络商品交易监管的对策

摘　　要：网络商品交易是21世纪的新型交易模式,与传统商品交易模式相比打破了空间和时间限制,具有加入行业程序简便、交易成本低和手段快捷的特点。由于网络商品交易监管法律和制度不健全,交易过程中假冒伪劣商品增多,侵犯消费者合法权益案件逐年上升,破坏了网络交易的正常秩序。通过加大网络经营者诚信守法经营理念宣传,完善监管制度和法律,明确监管机构职责和责任,加强网络经营主体行为监管,严厉打击经营者违法经营行为,才能促进网络商品交易活动良性发展。The network commodity transaction is a new transaction model in the 21 st century. Compared with the traditional commodity transaction mode,it breaks the limits of space and time,and has the characteristics,such as： To join the trade procedure is simple; The transaction cost is low and the method is rapid. Due to the laws and regulations of network transaction supervision are not perfect,the fake and shoddy goods in the process of transaction have increased,and the cases of infringing the legitimate rights and interests of consumers have increased year by year,thereby disrupting the normal order of the network transaction. Only by increasing propagandist strength of the integrity law- abiding business philosophy of the network operators,improving the system of regulation and law,clear regulatory duties and responsibilities,strengthening the supervision of network management main body behavior,severely cracking down on illegal business behavior of operators,can the benign development of the network commodities trading activities be promoted.
