摘  要:中国反就业歧视法研究亟需反思美国经验和教训,建构对于制度和理念、实然与应然的系统理解,创立一般理论。一般理论围绕歧视所对应的平等观念展开,中国已经树立了以用人绩效为价值追求的主流平等观,据此初步生成了反就业歧视法的"侵权法模式"。但是,侵权法模式面临挑战,其根源在于主流平等观无法处理用人绩效与其他价值之间的冲突。为此,中国反就业歧视法应当树立以改善群体弱势地位为价值追求的新平等观,界定其与既有平等观之间的关系。新平等观获得宪法文本和行宪机关的支持,落实为制度,就可能产生反就业歧视法的"宪法模式"。In the research on employment discrimination law, Chinese scholars need to develop a systematic understanding of such concepts as institutions, ideas, objective facts and subjective requirements and create a general theory on the basis of summarization of U. S. experiences and lessons. The core of such a general theory is the concept of equality that the law aims to realize. China has already established a mainstream merit-oriented concept of workplace equality and the corresponding "tort model" of employment discrimination law. This model, however, is faced with challenges because its underpinning concept of equ solve the conflict between employment merit and other public values. To solve ality this is unable to problem, the Chinese employment discrimination law should promote a new concept of equality that focuses on the improvement of the socio-economic status of disadvantaged groups and clarification of the relationship between the new concept of equality and the old concept of equality. With the support of constitutional text and constitutional enforcement institutions, the new concept of equality can be institutionalized and a constitutional model of employment discrimination law may emerge
