摘　　要：文章以"叔侄强奸案"为引言,以公诉环节中的反证为切入点,将民事诉讼中的反证概念引入到刑事诉讼中。通过对反证在刑事诉讼中的概念界定,审视刑事诉讼中反证的司法现状,以期通过反证这一概念的引入对防范冤假错案的发生起到积极的促进作用。The author started from disproof of public prosecution, introduced the concept disproof in civil procedure into criminal procedure with the rape case of uncle and nephew as preface, defined the concept of disproof in criminal procedure, examined judicial situation of disproof in criminal procedure so as to play an active role in preventing false and wrong cases.
