检察机关附条件不起诉裁量权运用之探讨

摘　　要：新刑事诉讼法增设附条件不起诉制度,不仅使未成年犯罪嫌疑人能避免因起诉而受有罪判决的前科烙印,更重要的是使未成年犯罪嫌疑人能于刑事设施外,依其自助的精神致力于自我的更生与自律,是一个值得推行和推广的理想刑事政策运作模式。检察机关在附条件不起诉裁量权行使过程中,应以特别预防需求作为核心考量,在裁量形态与处分内容的选择上,应遵循合目的性、必要性与比例原则的要求,本着特别预防、犯罪嫌疑人最小负担原则,协调关系人相互间的利益,促成未成年犯罪嫌疑人的社会复归,在广泛而多样的裁量权限中,找到一套合目的、安定而可行的运作基准。Conditional non-prosecution system in the revised Criminal Procedure Law does not only enable juvenile criminal suspects to avoid the stigma punishment carries, but also grants them the opportunity of rehabilitation beyond prison, which is worth implementing and popularizing. In the course of exercising this power, the procuratorial organs should take special prevention as the core consideration, and endeavor to reach the unification of purposiveness, necessity and proportionality. They should also balance the interests of both parties, promote social return of juvenile suspects in the consideration of special prevention and minimum burden in suspect, and aim to find a purposeful, stable and feasible way among the various practices of discretion.
