摘 要:文章以漳州市芗城区劳动监察大队所收集到的案例为基础,从该地区讨薪劳动者通过劳动监察途径进行维权的角度出发,分析了劳动者在维权讨薪过程中解决途径:劳动监察介入协商解决、劳动监察立案调查解决、劳动仲裁解决、法院解决等四种路径方式。并对四种路径所需的手续和材料等进行详细的流程分析,从而测算每条路径所需要的时间和资金成本。并针对不同路径提出相关的优化建议,以期望更好更快地降低讨薪劳动者维权成本。Based on the cases collected by the labor inspection team in Xiangcbeng District of Zhangzhou City, the paper analyzed employee rights-preservation solutions from the perspective of labor supervision. There were 4 solutions: labor supervision consultation, labor supervision case investigation, labor arbitration solution, and court solution etc. A detailed analysis on the required procedures and materials of the four kinds of solution was conducted in the paper, to measure the cost of time and capital required for each solution. Finally, it put forward some related optimization suggestion for different solutions, with the expectation to reduce the cost of employee rights- preservation better and faster.
