摘　　要：高校办学自主权是一种广义上的公共权力,由高等教育的公共性及其内在规律所决定,这种公权力具有自治行政、国家监督的特性。法律授予高校办学自主权的内容和范围,实质上是国家对高等教育规律的确认,政府不可以任意予夺或僭越。高校办学自主权没有"落"到"实处"是多重因素的结果,就民办高校而言,在法律层面失之具体,规章层面管控过多的制度安排下,既与相关行政部门的权力边界限定缺位以及政策与法律抵牾、行政治教一以贯之有关,也与对现代大学制度本质认识滞后及对民办教育的歧视有关。落实高校办学自主权"道阻且长",其主要障碍是:教育政治化的意识形态依然存在;行政管理惯性力量强大;控制型管理体制机制变革缓慢。The autonomy in university running is a public right in a broad sense,and it is determined by the publicity of higher education and its inner rules.This kind of public right has such features as autonomous administration and state supervision.The law has conferred the content and range of autonomous running for universities,which means that the State government cannot intervene in the confirmation of the rules of higher education at its will.There are various factors for the failure in the autonomy in university running in practice,such as the deficiency of the specific laws and the over management from the government.It also has some connections with the absence of the power borderline of relevant administrative departments and the conflicts between laws and policies and the combination of administration and education as well as the lag on the realization of the essence of modern university system and the bias of private education.There is still a long way to put the autonomy of private universities into practice.There are three main obstacles,which are the existence of the ideology of educational politicization,the formidable inertial force of administration and the slowness of the change of command control management system.
