摘　　要：2012年7月,德国《促进调解及其他诉讼外冲突解决程序法》(以下简称"德国调解法")颁布实施,这是德国冲突解决方式发展中的一个里程碑,这部法律强调以温和的方式来解决当事人之间的冲突、纠纷,完全突破了德国19世纪70年代以来以激进方式解决冲突的传统法律思想。所以,笔者在访问了德国相关政府网站、阅读了国内研究该部法律的学者的文章,搜集了许多文献资料,将会在本文中,从自己的角度去看待德国调解法,介绍德国调解法。同时,还会结合我国现行有效的《中华人民共和国人民调解法》与德国调解法进行对比,取其长处,提出促进我国现有调解制度的发展的建议。In July 2012 , the German “Laws Concerning Promoting Mediation and Conflict resolution procedures and Other Proceedings”（hereinafter referred to as “German Mediation Law”） was promulgated , [1 ] This is the way to solve the conflict in Germany and is a milestone in solving conflicts . This law emphasizes gentle way to resolve the conflict between the parties , disputes , completely breaking the German nineteenth century seventies radical solution to the conflict in the tradition of legal thought . By visiting some relevant government website , reading the domestic laws of scholars studying the article and collecting a lot of literature , the author of the paper , from their own perspective on the German Mediation Act , introduces German Mediation Act and also makes a comparative study of “People＇s Republic of China People＇s Mediation Law” with German Mediation Law and makes recommendations to promote the development of our existing mediation system .
