摘 要:"准司法权"是指土地部门行使土地流转裁决权,该裁决权不同于法院的裁判权。行使"准司法权"遵循程序越多,其法定化程度的要求也越高。民族地区农村具有高土地流转率与非均衡性特点。民族地区农村土地流转中政府"准司法权"的程序性限制,是依法和适度调节土地流转的手段,也是我国土地流转法规的发展方向。为了规范"准司法权"在土地流转中扩张,应调整程序性规范的运作,优化调节主体自身的调节程序和对策程序。" Quasi judicial power means the land department shall exercise the land transfer adjudication which is different from the court adjudication. The more procedures quasi judicial power follows, the higher legalization requirements it must meet. Ethnic regions have both characteristics of high land transfer rate and the non - equilibrium. Procedural restrictions on governmental "quasi judicial power" in rural land transfer of ethnic regions serve as means by which land transfer is legally and appropriately adjusted, and also point the direction of China's land transfer regulations. To regulate the expansion of "quasi judicial power" in the course of land circulation, it is advisable to adjust the procedural norms, optimize adjustment procedures and countermeasure procedures of the government itself.
