摘　　要：通过对我国目前非诉讼纠纷解决机制的形式和存在的问题的研究与讨论,分析了第三方调解机制的特点和优势,对比并借鉴了国外发达国家的先进经验,提出了构建更加有效的医疗纠纷第三方调解方式的政策建议:制定相关法律;要全面引入并强制推行医疗责任险;建立"医调委"与医疗责任保险机构的衔接机制;完善"医调委"的队伍和制度建设。This paper analyzed the advantages and disadvantages of The third party mediation mechanism through the research and discussion on non-litigation dispute resolution mechanism in China and the existing problems and learn from the advanced experience of foreign countries, then put forward policy proposals to build a more effective third party media- tion of medical malpractice： formulating relevant laws; comprehensive introduction and enforce the medical liability insur- ance ; setting up medical committee and cohesive mechanism of medical liability insurance institutions ; improving the sys-tern of ＂medical committee＂ team and construction.
