摘　　要：非法证据排除规则作为一项保障人权的重要制度性规定,已经被我国新刑事诉讼法所引入。这项规则在起到保障人权功能的同时,客观上也给承担起诉职能的公诉机关带来了一系列影响。为了应对这些可能出现的问题,公诉机关必须转换办案观念,建立内部自我约束机制,细化操作规则,防止非法证据排除规则被滥用。Being an important system of regulations on the protection of human rights, the rule of illegal evidence exclusion has been introduced in the new criminal procedure law in our country. It has objectively brought a series of influence to the public prosecution when protecting the human rights. So it must convert the case handling concept, establish the internal self-restraint mechanism, and refine the detailed operation rules to prevent the rule abuse.
