关于中国中医药立法的思考

摘　　要：中医药事业发展面临着无法可依的难题,急需制定一部符合中医药自身特点和发展规律的中医药法。在内容上,应当明确中医医疗机构的法律地位和扶持制度,应当对中医药从业人员进行分类管理,应当建立中医药传承制度、中医药传统知识保护制度和野生药材资源保护制度,进一步规范医疗机构中药制剂。通过立法,保护、扶持和促进中医药事业发展。The development of TCM（traditional Chinese medicine） is faced with the problem of being lawless, so it is very urgent to formulate a law according to the characteristics and deve lopment disciplines of TCM. As for the contents, its legal status and supporting system of the medical institutions of TCM should be clarified, the practitioners of TCM should be classified and managed, the transmission system, the protection system of traditional knowledge of TCM, and the protection system of feral medicinal material should be established, and the medical institutions of TCM should be standardized so as to protect, support and promote its development through legislation.
