摘 要:本文在界定环境监管概念并与环境管理、环境治理区分的基础上,提出在环境监管中存在地方政府与公众两类地位不同的主体;结合政府监管理论、公众参与理论,深入分析了两类主体的优势和弊端,提出在强调地方政府主导性时,需要通过公众参与来克服其局限性;在肯定公众参与的正当性时,也需要通过地方政府的合理引导来避免其自发性。运用协同理论,提出地方政府与公众在环境监管中应取长补短、合作共赢,建立地方政府主导、公众有序参与的协同机制,进一步提高环境监管的有效性,实现经济与环境的协调发展。Two kinds of different position main body of local government and public in the environmental supervision are put forward by the definition of environmental supervision and its distinction between environ- mental management and environmental governance. The advantages and disadvantages of two kinds of main body are analyzed in detail by combining the theories of government regulation and public participation. The limitations of local government can be overcome by public participation when the dominance of local govern- ment was emphasized. The spontaneity of public participation can be avoided by the reasonable guide of local government when the legitimacy of public participation is affirmed. It is put forward by using collaborative the- ory that the local government and the public should exert their forces in environmental supervision, comple- ment, interact and cooperate with each other. The synergy mechanism of local government leading with public participation orderly should be established in order to improve the effectiveness of environmental supervision and to realize the harmonious development of economy and environment.
