论法治主体的界限意识  

On the Boundary Awareness of Legal Subjects

摘　　要：鉴于中国法治现代化过程中,缘起于人的欲望之界限意识重要性,梳理了古希腊时期知名哲人、政治家对界限意识的描述,并在刘进田教授界定界限意识的基础上,提出了应当注意的四个问题:界限意识是指个人与个人之间的界限意识,人与自然之间是无法谈起界限意识的;在谈论界限意识时应当注意到个体与个体之间的平等关系;界限意识的产生与人的自我意识的觉醒几乎是同步的;界限意识是指个体人的自我意识,而不是群体人的自我意识。In view of importance of boundary awareness about people＇s desires in the modernization of Chinese legal system, the paper sums up the descriptions of boundary awareness by famous philosophers and politicians in ancient Greece. Then based on the definition of boundary awareness given by Professor Liu, four problems that should be paid much attention to are presented：1 ）boundary awareness refers to the one between individual and individual, while between human and nature there is no possibility talking about boundary awareness;2） the equal relationship between individuals should be concerned in talking about the boundary awareness ; 3 ） the occurrence of boundary awareness is almost synchronous with the awakening of self - awareness ;4） boundary awareness refers to the self - awareness of individual, not of groups.
