483家职业病危害企业劳动合同和工伤保险现状调查

摘　　要：目的了解楚雄州483家职业病危害企业劳动合同和工伤保险签订情况,为保障劳动者合法权益提供依据。方法根据楚雄州职业病危害调查的方案,对职业病危害企业的劳动合同和工伤保险现状进行调查。结果楚雄州共有职业病危害企业483家,签订劳动合同的企业398家,占82.40%;劳动合同签订人数33 227人,签订率为88.68%;合同中有职业病危害内容的企业数占63.82%,合同终止或解除后进行备案的企业数占59.80%,签订集体合同的企业数占39.45%。参加工伤保险的企业391家,占80.95%,实际参保人数34 358人,参保率为96.18%。不同地区、不同企业规模、不同经济类型、不同行业职业病危害企业之间劳动合同签订率比较,差异均有统计学意义(χ2=2 637.07、1 407.15、2 531.07、845.76,P<0.01);不同地区、不同企业规模、不同经济类型、不同行业职业病危害企业之间工伤保险参保率比较,差异亦均有统计学意义(χ2=2 154.05、334.04、615.87、416.77,P<0.01)。结论楚雄州职业病危害企业劳动合同签订和工伤保险参保状况不容乐观,建议加大对职业病危害企业的监管力度,督促企业为工人签订合法的劳动合同和购买工伤保险。Objective To learn about the current situation of labor contract and industrial injury insurance in 483 enterprises in Chuxiong,in which workers were exposed to occupational hazards,and to provide the basic information to take measures for the protection of the legitimate rights and interests of laborers. Methods The standardized questionnaires were used to investigate the current situation of labor contract and industrial injury insurance in the enterprises. Results In Chuxiong,Workers in 483 enterprises were exposed to identified occupational hazards. Among them 398 enterprises signed the labor contract with their workers,accounting for 82.40%. A total of 33 227 workers signed the labor contract and the signing rate was 88.68%,and 63.82% enterprises showed clearly the existed occupational hazards in each labor contract,59.80% enterprises presented the records to the authorities promptly after they terminated labor contract with workers,39.45% enterprises signed the collective labor contract with their workers. A total of 391 enterprises participated in the work injury insurance,accounting for 80.95%,and 34 3 58 workers were insured,accounting for 96.18%. It was noted that there were significant differences in signing rates of labor contract among enterprises with different scales or economic types,or in different Industries,or located in different areas（χ2 = 845.76,2637.07,1407.15,2531.07,P〈0.01）. It was also noted that there were significant differences in work injury insurance rates among enterprises with different scales or economic types,or in different Industries,or located in different areas（χ^2 = 416.77,2154.05,334.04,615.87,P〈0.01）.Conclusion The fulfilment of labor contract and work injury insurance was not optimistic among enterprises in Chuxiong and the government agency should supervise these enterprises to protect workers.
