摘　　要：第三人撤销之诉,主要是在案件受审产生判决结果之后,对案外人合法利益产生负面影响,进行合法维护的一项制度。随着我国经济的发展,社会文明也在不断进步,人们的思想觉悟程度也提高了,对法律的掌握也慢慢成熟起来。然而也正是因为如此,出现了一些利用法律来实现自己不合法利益的不法人员,这样对于第三人的合法权益将会产生很大的威胁。针对目前这种现象,我国一开始没有设立相应的法律法规对此进行管制,而第三人撤销之诉也因为实施时间不长,在实践过程中运用的并不成熟,且没有一致的标准,故此第三人撤销之诉的开展并不理想。因此,本文主要讨论第三人撤销之诉,分析其中存在的问题,并提出完善的对策。The lawsuit withdrawn by the third person is mainly a system that after the trial of the case, the third party used to conduct a legal maintenance to the negative impact on the legitimate interests.As China’s economic development, social civilization has been steadily progressing,the degree of ideological consciousness of people also increased and the grasp of the law slowly mature. Yet it is precisely because of this, there have been some criminals using the law to achieve their illegitimate interests, so there will be a huge threat to the legitimate interests of the third party. Aiming at this phenomenon, there weren’t appropriate laws and regulations to regulate this at the beginning. And the lawsuit withdrawn by the third person wasn’t carried out satisfactorily because the implementation time is not long, the use in practice is not mature and there is no consistent standard.Therefore, this article focused on the lawsuit withdrawn by the third person,analyzed the problems and proposed measures to improve.
