摘　　要：中国共产党对刑事法制的领导是中国刑事法制的一大特色。这种领导主要是通过刑事政策来实施的。在《刑法》颁布实施以前 ,党的刑事政策曾经起过《刑法》的作用 ;在《刑法》颁布实施后 ,党的刑事政策仍然起着指导、审视、修改、完善《刑法》的作用 ,无论对刑事立法还是对刑事司法 ,都具有根本的指导意义。坚持党对刑事立法和司法的领导 。Criminal law system under the Chinese Communist Party is one of the features in Chinese criminal law system. This leadership is done mainly by criminal policy. Before Criminal Law, the Party's criminal policy owned the function of the Criminal Law. After Criminal Law, the Party's criminal policy still directs, surveys, revises and improves the Criminal Law and has guiding significance in both criminal legislation and criminal justice. Legislation and Justice under the Party's leadership is a political principle of Criminal law system in China.
