摘　　要：在民法上,作为事业单位法人的大学既不具备独立的行为能力,也不具备独立的责任能力;在行政法上,作为授权行政主体的大学,却享有一系列的"自主权"。唯有从宪法学角度,认定大学的宪法根基是宪法规定的基本权利——学术自由,大学行使的是学术权力,才能解开大学的"自主之谜"。As a public institutional legal person in civil law, the university does not have independent capacity, nor the independent ability of responsibility; As the authorized administrative body in administrative law, the university has a series of ＂ autonomies＂. Only from perspective of the constitution,can we recognize that the constitution foundation of the University is the basic right of academic freedom and University exercises academic power. This can solve the mystery of ＂University autonomy＂.
