高校学生受教育权救济机制的完善措施研究

摘　　要：高校学生希望受教育权得到充分保障;另一方面为维持内部秩序,高校依法行使公共管理职能。当学生因严重违反学校纪律,关系到受教育权是否能继续享有时,难免会引起高校与学生的争议,甚至学生与高校之间发生诉讼。因此,对高校学生受教育权的救济机制予以完善,是亟待解决的课题。The students want their rights to receive education can be fully guaranteed in higher vocational colleges. On the other hand,the universities must perform some public management functions to maintain the internal order. The students face the seriously violate the college disciplines in terms of whether they can continue to enjoy the right to receive higher education,the conflicts can be occurred between universities and students inevitably,even in litigation between students and colleges. Therefore,it is an urgent subject to be solved for the perfected measures of the relief mechanism for the university students＇ right to receive education.
