摘　　要：未决羁押人员及其近亲属的社会保障权长期被忽视,可能产生严重的社会问题。通过对四川省Z市、Y市的未决羁押人员、看守所干警、社区工作人员、普通公众等群体的调研,发现未决羁押人员及其近亲属在社会保险、社会福利、社会救助等多领域均面临严峻问题。探寻其原因,主要在于传统政治观念冲突、传统文化观念影响、政策法规瑕疵、诉求表达不畅等。结合世界各国的立法、司法实践经验,充分考虑未决羁押人员人权保障在我国当前所受的制约因素,提出修订法律法规、完善诉求回应制度、加强职业技能培训、试行羁押社会化等建议,以期为人权司法保障的落实和相关法律法规的出台提供参考。The long-term neglect of social security rights for personnel of pretrial detention and their close relatives could lead to serious social problems.Based on investigation and research towards such groups including personnel of pretrial detention,cadres and policemen of detention house,community workers,the general public etc in City Z and City Y of Sichuan Province,we find that personnel of pretrial detention and their close relatives are facing serious problems in many fields including social insurance,social welfare,and social assistance.The root reasons could include the conflict of traditional political idea,the influence of traditional cultural idea,the flaw of related policy and regulation,the unsmooth channel of appeal and expression etc.Hence,combining with the experience of legislative and judicial practice all over the world,we fully consider the current restrictive factors in security of human rights for personnel of pretrial detention.Based on this consideration,we try to propose some related suggestions,including revising related laws and regulations,perfecting system of appeal response,strengthening training in occupational skills,and trying out detention socialization etc,so that we could provide references for implementation of judicial security in human rights and announcement of relevant laws and regulations.
