摘 要:当前我国对国企高管侵财型职务犯罪行为模式的分析还处于仅以犯罪学的内外因论为理论支撑的经验实证分析阶段。为深入揭示国企高管侵财型职务犯罪行为机理,应引入新的分析工具——"GONE理论"探寻可操作性的治理对策。国企高管侵财型职务犯罪属于在以实现自利最大化为目标的行为理性的驱动下而主动作出的行为选择。依据"GONE理论",国企高管侵财型职务犯罪的"自利理性"表现为贪婪和需要因子,其"实现自利最大化"的条件表现为机会和暴露因子。Now, the analysis on behavior patterns of post embezzlement crime by Chinese corporate executives in china is a kind of empirical analysis based on the theory of the cause of interior and exterior from criminology. In order to reveal the mechanism of post embezzlement crime by Chinese corporate executives, we should introduce a new kind of analysis tool, "GONE Theory", to find practical control measures. Post embezzlement crime by Chinese corporate executives is a kind of rational behavior choice made actively by the executives who seek to gain the maximum benefit. According to "GONE theory", "self-interest ration" in post embezzlement crime by Chinese corporate executives is greed and need, the condition of "gain the maximum benefit" is opportunity and exposure.
