摘 要:缔约自由和劳动者就业自由被视为商品经济社会发展的根基,在经济全球化趋势的影响下,劳动者的跨国流动带来了各国保护劳动者法律的冲突。美国遵循传统判例法的模式并没有将劳动合同专门立法,而是在保护劳动者选法自由的前提下,通过"禁止就业歧视"的公共政策排除不当的准据法适用。欧盟规则是通过《罗马规则》单独规定劳动合同的法律适用原则和强制性规范,进而实现意思自治和公共利益的平衡。对比欧美劳动者保护的模式,借鉴欧盟成文法的规定,中国的劳动者保护模式应该引入有限制的当事人意思自治原则,辅之以最密切联系原则进行兜底。Contractual freedom and employment at will are the foundation of the development of commodity economy society. Under the influences of economic globalization trend, laborers'transnational flow brought about the conflicts of laws for laborer protection in different countries. In the united state according to the case law tradition, employment contract applicable law for transnational flow is not specially provided in the choice of law rules, however the choice of applicable law for transnational employment contract is regulated by the public policy of "forbidden of employment discrimination". In European Union to keep the balance between party autonomy and public interest, it clearly provided the basic principles of choice of law in employment and mandatory rules in ROME RULES Ⅱ. Compared the different modes the author suggested that we should use the regulations in European Union for reference. We should accept the principle of limited party autonomy, and use the principle of the most significant relationship as fallback provisions.
