交往理性:国有企业家职务犯罪防治的新思路

摘　　要：哈贝马斯的交往理性理论为研究我国国有企业家职务犯罪的防治提供了崭新的思路。国有企业家职务犯罪难以根除,只能控制在可容忍的范围内,在确立这一理念的基础上,构建理性交往平台,通过自我反思和平等商谈对话的方式寻求防治国有企业家职务犯罪的前提条件和制度导向,最后通过全民参与、对权力重新合理设置及加强权力运行的监控等具体措施来防治国有企业家职务犯罪。Habermas＇ theory of communicative rationality provides a new way of studying duty crime prevention in state- owned entrepreneurs. The duty crime of state- owned entrepreneurs is difficult to eradicate,and can only be controlled within a tolerable range. Having established the basis of this idea,we should build the rational communication platform,seek the preconditions and system orientation of duty crime prevention of state- owned entrepreneurs by way of self- reflection and equal dialogue,and finally prevent duty crimes of state- owned entrepreneurs through public participation,and a reasonable set of power re- power operation and specific measures to strengthen monitoring and etc.
