摘 要:不动产登记机构登记错误侵权行为的构成应以违法行为为中心,"过错"不是构成要件之一。法释[2010]15号规定的"未尽合理审慎职责"应解读为不动产登记机构登记错误侵权行为的"违法行为"要件。不动产登记机构登记错误侵权行为必须满足三个条件:其一,必须是职务行为;其二,属"未尽合理审慎职责"行为;其三,登记错误与造成损害事实。不动产登记机构登记错误侵权行为的类型分为单独侵权和共同侵权。共同侵权可区分为有意思联络的共同侵权和无意思联络共同侵权两类。The constitute elements of real estate registration agency for error infringement should be centered on violations. "Fault"is not one of its constituent elements. The Judicial Interpretation No. 15[2010]prescribes that"not doing reasonably prudent duties",which should be interpreted as an element of real estate registration agency for error infringement. Real estate registration agency for error violations must meet three conditions: first,it must be job behavior; second,it is "not doing reasonably prudent duties"; third,there is registration error and causing damage. Real estate registration agency for error infringement can be divided into two types: separate infringement and contributory infringement.Contributory infringement can be divided into contact contributory infringement and contributory infringement without meaning contact.
