摘 要:法家在近代的复兴,除了时代的召唤之外,还存在着发生在儒家内部长时期的学术史的准备。从章太炎的荀学研究入手,观察从清代中期不断壮大的礼学思想及其在晚清西学东渐背景下的变形,可以发现,章太炎在重新梳理法家人物谱系的基础上试图进行新的儒法互动。章氏将"法"的概念回溯至《周礼》,法家由此超越了自汉代以降的单纯工具论的层面。在西方现代学术思想以及经典文献所记载的原始礼法的汇流中,儒、法关系实现了创造性转化。加强制度建设无疑是晚清政治治理的基本课题,而在章太炎的思路中可以见出,道德建设依然有着至关重要的地位。The rejuvenation of Legalists in modern times,apart from the call of the age,can be attributed to the long academic preparation of Confucianism. This paper aims to investigate the development of ritual thoughts during the mid-Qing Dynasty and their transformations in the context of "w estern culture communication to China"in the late Qing Dynasty by means of Zhang Taiyan's study on Xunism. Through sorting out the genealogy of the representatives of the Legalists,he made a new interaction betw een Confucianism and Legalism. Zhang Taiyan traced the concept of "legal"to the Rites of the Zhou,thus makes the Legalists go beyond the idea of instrumentalism w hich w as held ever since Han Dynasty. In the communication of modern w estern academic thoughts and traditional rites recorded in the classics,a creative transformation of the relationship betw een Confucianism and Legalism has been made. It is necessary to strengthen the system construction for political governance in the late Qing Dynasty. How ever,it is still of vital importance for the moral construction,according to Zhang Taiyan.
