摘　　要：道路交通事故侵权是现代社会主要的类型化侵权行为之一。但对道路交通事故侵权责任应采行何种归责原则,采用传统法学研究方法的比较普遍。本文则从法经济学的视角,运用博弈论方法研究侵权法,并在此基础上提出结论。Tort liability in road traffic accident is a main type of tort in the modern society. However, all through the ages, in China＇s law society, there are disputes on how to adopt a proper criterion of liabili- ty for tort liability in traffic accident. These dis- putes are using the traditional method of jurispru- dence research conducted by, but not by game theory and economics theory, So, trying to apply the game theory method in tort law study,and put forward the research conclusion. From this point of view, the greatest sig- nificance lies not in conclusion, but the innovation of methodology.
