善治:国有公司治理的必然诉求

摘　　要：善治是指人们恪守人文精神,将法治方式作为解决社会问题的最基本方式式,促进社会公平互动,实现自治与协调的过程。在依法治国背景下,创新国有公司治理,实现善治,不仅关系到国有公司的生存与发展展,还关系到国计民生的安全与保障。善治要求治理状态自治性、治理主体包容性、治理目的人文性、治理方式法治性、治理过程互动性。可是,当前我国国有公司治理存在偏离善治的一些表现。为了实现善治,国有公司应做到立足实际,构建治理良法,创新治理机制,践行人文精神,培育法治文化,重组治理结构。Good governance refers to the behaviors that the people abide by the humanistic spirit, and use the way of rule of law as the most basic way to solve the problems of the society, promote social equity and interaction, and realize autonomy and coordination. Under the background of the rule of law, the innovation of state- owned corporate governance is helpful to achieve good governance, which is related to the survival and development of state - owned companies and also to the security and safeguard of national economy and people＇ s livelihood. However, good governance requires that governance state is autonomous, governance bodies are inclusive, governance aim is humanistic, governance approach is the rule of law, and governance process is interactive. But, the current stateowned corporate governance has some performance deviations from good governance. Therefore, in order to achieve good governance, the state -owned company should be based on actual situation, build good governance law, renew governance mechanism, practice humanistic spirit, cultivate the rule of law culture, and restructure the governance structure.
