摘　　要：在"诉讼爆炸"的社会转型时期,诉权滥用不仅是一个潜在的更是一个现实的社会问题,其具有侵害他人权益、浪费司法资源、激化社会矛盾、阻碍司法改革等一系列社会危害。我国缺乏对"诉权滥用"的理论研究和立法规制,这就使得在我国当前社会语境下讨论"诉权滥用"具有相当的必要性。In this transitional period of litigation explosion,abuse in right of action is not only a potential but also a realistic social issue,which brings a series of social harmfulness such as infringing other’rights,wasting judicial resources,triggering social conflicts,and obstructing judicial reform.However,lack of theoretical research to regulate this social issue makes it necessary to explore the necessity of abuse in right of action in current social ontext in China.
