摘　　要：电子商务依托现代高新技术全面改变着传统贸易的经营理念和方式 ,其表现载体数据电文应用到诉讼领域成为电子证据。与传统证据相比 ,电子证据的可接受性、证明力以及搜集采信等问题存在较大立法障碍和适用困难。必须加强研究电子商务证据新特点 ,借鉴国际组织有益探索 ,逐步建立我国电子证据法律制度 。E commerce, depending on modern Hi tech, is currently changing the operating principle and transaction forms of traditional trade fundamentally. Its practical form Electronic document is referred to as Electronic Evidence if used for action . Compared with traditional evidence and as far as the acceptibility, the proof and collecting materials are concerned, electronic evidence is faced with barriers in legislation and application. There still exists much difficulty concerning its order to smooth out the way for the development of E commerce legally. We should research further into the new characteristics of electronic evidence, use the experience of International Organizations for reference and make our own law of e commerce gradually to provide law guarantee for the smooth development of our electronic commerce.
