民事诉讼检察监督听证制度及规范化建议

摘　　要：2013年,《人民检察院民事诉讼监督规则(试行)》在审查一章中,规定了民事诉讼检察监督听证制度。听证制度的规范化对于民事检察监督案件的公开审查、确保诉讼监督工作公正合法、维护民事诉讼中双方当事人的合法权益、提升检察机关司法公信力、维护社会和谐稳定具有重要价值。文章从听证制度存在价值的基础入手并结合实践,对如何完善、规范该制度提出几点建议。In 2013, the chapter of review of ＂People＇ s Procuratorate Civil Supervision Rules （Trial Implementation）＂ provides the hearing system of prosecutorial supervision in civil action. The standardization of hearing system has the important value in the public review of civil prosecutorial supervision cases, ensuring fair legal proceedings supervision, safeguarding the legitimate rights and interests of the parties in the civil action, enhancing the judiciary credibility of procuratorial organs, and maintaining social harmony and stability. From the base of the existence value of hearing system combined with practice, the author puts forward a few suggestions on how to improve and standardize the system.
