检察机关支持社会组织提起环境民事公益诉讼的法律问题研究——基于最高人民法院司法解释的思考

摘　　要：《最高人民法院关于审理环境民事公益诉讼案件适用法律若干问题的解释》将检察机关在环境民事公益诉讼中的法律地位定位于"支持起诉",反映出环境民事公益诉讼的本质特征以及特殊性,是民事法律关系私法属性和法律监督机关内在属性的具体体现。检察机关支持社会组织提起环境民事公益诉讼的路径应从支持起诉的主体、对象、内容、程序进行设计。同时,健全检察机关支持社会组织提起环境民事公益诉讼的立法保障、组织保障以及实效保障,使检察机关支持社会组织提起环境民事公益诉讼的法律规定确有成效,更好地保护环境公共利益。＂Some problems of interpretation of the Supreme People＇s Court on applicable law about the handling of civil environmental public interest litigation cases＂ determines that the legal status of procuratorial organs is ＂supporting the prosecution＂ in the civil environmental public interest litigation. The interpretation reflects the particularity and essential characteristics of civil environmental public interest litigation. It also expresses private law attributes of civil legal relation and inherent attributes of legal supervision organs. The way that Procuratorial Organs supports that social organizations initiate civil environmental public interest litigation should be designed by supporting main body, object, content, procedure. At the same time, improving the legislative, organization and practical guarantee makes the law validity to better protect the environment public interest.
