摘　　要：新媒体时代的全面到来,使我国高等教育法制建设在基本理念、运行环节、法律关系与权力行使等方面面临难以回避的挑战与前所未有的机遇。在应对挑战与把握机遇的过程中,高等教育法制设计与运行的基本导向应该包括:凭借新媒体时代提供的重要契机倡导权利与义务并重的高等教育法制理念,依托新媒体时代营造的舆论环境规范高等教育法制的建设与运行,按照新媒体时代反映的公众诉求平衡高等教育法制中的法律关系,依靠新媒体时代催生的民主机制监督高等教育法制中的权力行使。The arrival of the New Media Age, exposes our country＇s higher education legislation construction to unavoidable challenges and unprecedented opportunities in basic conceptions, the operation process, legal relationship and the exercise of power. In meeting challenges and grasping opportunities, the design and operation of higher education legislation system should rely on the important turning point brought about by the New Media Age to advocate the legislative conception that we should pay equal attention to right and duty, depend on the public opinion environment created by the New Media Age to instruct the construction and operation of higher education legislation system, balance legal relationship of higher education legislation system according to public demand in the New Media Age, take advantage of the democratic mechanism in the New Media Age to monitor the exercise of power in higher education legislation system.
