摘  要:劳动关系认定作为劳动法的一个基础理论问题和重大制度安排,在法治中国背景下已成为当前我国劳动法理论、立法与实务共同面临的一个难题。劳动关系认定的随意性使劳动法遭遇选择性施行,并使劳动司法面临根本性难题。劳动关系认定在应然层面上,非独立和静态问题,应置身于我国劳动用工制度改革与经济社会发展大背景,才能获得最充分的解读。现有研究与实践多从个案或主体视角观察劳动关系,试图通过个案解析或主体"画像"来归结劳动关系认定的标准。这既是我国劳动关系标准论体系构建的自觉尝试,也是我国劳动关系认定理论不足的必然反映。劳动关系认定需要系统考量,其本质是一种利益格局的调整,需有明确的价值指向,以统领制度建设的方向;劳动关系认定还是一个关系范畴,需在不同主体不同行为之间动态把握,以提炼劳动关系认定之内核。同时,我国劳动关系认定标准之构建需走出传统"从属性循环"之怪圈,回应日益多样化人力资源市场的客观需要,以"历史经验"和"现实体验"作为理解我国劳动关系的双重视角,树立"大劳动关系"之观念,建立一种"系统从属性"与"不完整从属性"并举的双层标准体系,方能最大限度适应现代人力资源市场及灵活用工之趋势。As a basic theory issue of labor law and an important institutional arrangements, labor relations iden- tifying is a difficult problem in the current labor law theory, legislation and practice of our country. , which makes the labor law encounter the selective implementation. Determination of labor relations in the aspect of value,is not an independent and static problem. Only returning to the large background of our labor employ- ment system reform and the development of economy and society can we obtain the best interpretation. The ex- isting research and practice from the perspective of labor relations case or subject, attempts to refine the labor relations identified standards through the case analysis or subject "portrait". This is a kind of awareness error, also a kind of method error. The essence of labor relations identified is an adjustment of the pattern of inter- ests, needs to have a clear value orientation, to guide the direction of system construction ; and labor relations i- dentified is also a category of relationship that needs to grasp the dynamic between the different subjects, to ex- tract the core labor relations identified. Therefore, China' s labor relations identified construction should be out of the traditional "dependency circulation" standard, respond to the increasingly diverse needs of human re- sources market, establish the concept of large labor relations,the establishment of a "system dependency" and "incomplete dependency" ,to adapt maximally the trend of modern human resource market and flexible em- ployment.
